Tomáš Nahodil

Tomáš Nahodil specializes in our Czech law office in representing clients at the highest court´s instances - the Czech Supreme Court, Czech Supreme Administrative Court and Constitutional Court of the Czech Republic. Tomáš also represents our clients at the European Court of Human Rights. He focuses mainly on the areas of the Czech civil procedural, cadastral, offense, administrative and constitutional law. In 2013 he became the examiner of the attorney´s clerks from the constitutional and administrative law of the Czech Bar Association.

Tomáš graduated from the Faculty of Law of the Palacký University in Olomouc. Already during his law studies he gained his first legal professional experiences in the legislative process at the Office of the Government, the House of Commons and the Senate, from where he after four years left to practice advocacy. As a attorney´s clerk, he worked gradually in three medium-sized Prague law offices. He passed the lawsuit in 2008. Since then, he has provided legal aid to more than two hundred satisfied clients.

From the beginning of his advocacy practice, he has specialized in complex legal cases with an overlap in the protection of fundamental human rights: he writes the appeals to the Czech Supreme Court, cassation complaints to the Czech Supreme Administrative Court, constitutional complaints to the Czech Constitutional Court and complaints to the European Court of Human Rights.

Czech Administrative law

Tomáš has more than ten years of experiences in representing clients in the Czech administrative judiciary in the proceedings under the Czech Code of Administrative Court Procedure as well as under the Part Five of the Czech Code of Civil Court Procedure. He already represented clients, for example, in exercising their claims and protecting their rights under the Freedom Information Act, further when reviewing the decisions of cadastral, land and other administrative authorities. He represented well-known Czech university in a dispute with its student not admitted to the studies, as well as the students from the university studies excluded. He participated in the preparation of the lawsuit against the Rector of well-known Moravian university, who refused to appoint already nominated candidate for the Dean's office.

Czech Constitutional law

Tomáš's most well-known case, successfuly solved by the Constitutional Court of the Czech Republic, depends in reopening of extraordinary complicated restitution case of Opočno Chateau complex in Hradec Králové Region. In this case, the Constitutional Court newly interpreted the condition of racial persecution during the period of the Protectorate of Bohemia and Moravia (1939 – 1945) under the Extra-judicial Rehabilitation Act. Another success of Tomáš at the Constitutional Court depends in a decision according to which the restituents are not required to pay any court fees in restitution cases.

Publishing activities

Tomáš has been involved in publishing activities over the last fifteen years - besides articles for magazines Ekonom, Legal Advisor, Jurisprudence and Public Administration, he has also and mainly co-authored the commentaries on the Administrative Code published since 2005 as well as on the Local Referendum Act.

Tomas offers our clients a unique combination of professional legal knowledges and journalistic skills. Thanks to years of experiences in advocacy and journalism, he is able to quickly find the most important information for the case in a lot of other unclear information and to give them to our clients, counterparts and courts in a concise, comprehensible, and of course, convincing way.

Tomáš worked for three years as a radio and television journalist, thereof half a year focused mainly on judicial and legal issues. He devoted himself to the journalism firstly between 1994 and 1996 on the radio stations Radio Zlatá Praha and Frekvence 1 and then again in 2018, when he participated on Czech TV concerns preparation of news and publicity programs, publishing analyzes of medially well-known cases and articles on judicial and legal issues on the Czech TV website.

If his workload permits him, he still publishes articles on judicial and legal issues on the Czech Justice website.
